Please read this page carefully before you make any service by Spa Versante & Spa Versante website. By take any service by Spa Versante/Spa Versante website, online or offline, you acknowledge that you have read, understood, and voluntarily agreed to adhere to this Service Terms, Conditions & Waiver. You agree that this Service Terms, Conditions & Waiver​ has the same legal force and effect as a written contract with your written signature and satisfy any laws that require a written signature. If you do not agree to the Service Terms, Conditions & Waiver, then you shall not use any of the Services online or offline.

When you bring any other people to use any of the Spa Versante Services online or offline , it’s will be your responsibility to inform and alert them to ONLY proceed after they have read, understood, and voluntarily agreed to adhere to this Service Terms, Conditions & Waiver.

 

If Spa Versante decide to update our policy, the changes will be posted on this page. Spa Versante will notify you about significant changes by placing a prominent notice on this website.

Terms.Spa V management Ltd. (“we” or “us”) owns and operates the website at spaversante.com (the “Site”), where you can find information about our products and services. These Website Terms and Conditions (the “Website Terms”) describe the rights and obligations of an unregistered website user or visitor (“user” or “you”) in connection with your use of the Site. By accessing or using the Site in any way, including as an unregistered website visitor, you agree to be bound by these Website Terms and our Privacy Policy, which is available on the Site. These Website Terms apply only to your use of the Site, and the content made available on or through the Site, as an unregistered website user or visitor. If you use or access any of our physical space, restricted-access web-based services (i.e. those requiring a login), or other services we provide, your use of such space, services or program is subject to the terms and conditions you received or accepted when you signed up for such space, services or program. From time to time, we may make modifications, deletions or additions to the Site or these Website Terms. Your continued use of the Site following the posting of any changes to the Website Terms constitutes acceptance of those changes.

Eligibility. The Site and services it describes are available only to individuals who are at least 16 years old, unless we specify otherwise. No one under this age may access or use the Site or provide any personal information through the Site.
 

Content. The text, images, videos, audio clips, software and other content generated, provided, or otherwise made accessible on or through the Site (collectively, “Content”) are contributed by us or our vendors. The Content and the Site are protected by Canada and international copyright laws. We and our vendors retain all proprietary rights in the Site and the Content made available on or through the Site, and, except as expressly set forth in these Website Terms, no rights are granted to any Content. Subject to these Website Terms, we grant each user of the Site a worldwide, non-exclusive, non-sublicensable and non-transferable license to use (i.e., to download and display locally) Content solely for viewing, browsing and using the functionality of the Site. All Content is for general informational purposes only. We reserve the right, but do not have any obligation to monitor, remove, edit, modify or remove any Content, in our sole discretion, at any time for any reason or for no reason at all.

Disclaimer; Limitation of liability. To the extent permitted by law, we and our affiliates, parents, and successors and each of our and their employees, assignees, officers, agents and directors (collectively, the “Spa Versante Parties”) disclaim all warranties and terms, express or implied, with respect to the Site, Content or services (including third party services) on or accessible through the Site, including any warranties or terms of merchantability, fitness for a particular purpose, title, non-infringement and any implied warranties, or arising from course of dealing, course of performance or usage in trade. In no event shall the Spa Versante Parties be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the Site for (a) any special, indirect, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising) or (b) damages in excess of (in the aggregate) CAD$100.
 

Miscellaneous. These Website Terms shall be governed by and construed in accordance with the laws of the Province of BC, excluding its conflicts of law rules, and Canada. These Website Terms constitute the entire agreement between us regarding the Site and supersedes and merges any prior proposals, understandings and contemporaneous communications. If any provision of these Website Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Website Terms shall otherwise remain in full force and effect and enforceable. In order for any waiver of compliance with these Website Terms to be binding, we must provide you with written notice of such waiver. The failure of either party to enforce its rights under these Website Terms at any time for any period will not be construed as a waiver of such rights.

SPA VERSANTE SERVICE TERMS, CONDITIONS & WAIVER

 

Definitions & interpretation:

  1. Facility” means the Spa Versante, a Spa and spa Fitness facility located at the civic address of 120-130 8280 Lansdowen Road, Richmond, British Columbia, V6X 0B2 and contains the parkade, amenities (including but not limited to shower/sauna/steam rooms, lockers and more), and the furnishings inside as modified by Spa Versante in its sole discretion from time to time.

  2.  “Equipments & Products” means all the machines, equipment, appliance, tools, supplies & products that used to perform the Services or enhancing the pleasure of your visit (including but not limited to all the aesthetic and fitness machines, hair blower, yoga mat, weight tools, disinfectant products, testers, drinking water and more).

  3.  “Services” means all the services that provided by Spa V Management Ltd. online or offline, including but not limited to the beauty and wellness care and treatments, Yoga, Pilates & fitness training and classes, consultation, customer care and the Website Services.

  4. Plans” means any services package, series of classes, or any credit value (include but not limited to the prepaid membership card, all gift card, all gift certificate, series of classes, series of services etc.)

  5. Promotion” include but not limited to free/discounted gift/credit/service/product with purchase.

Safety & Liability:

  • You must be a natural persons who are 19 years or older and not under guardianship to consume in Spa Versante. 

  • You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to the Facility or use the Services. For example, this means:

    • you are responsible for leaving Spa Versante in the condition it was in when you arrived, and

    • you must act with integrity, treat others with respect, and comply with applicable laws at all times.

  • Equipments & Products we use are well selected through all the top brands from all over the world, and are health Canada approved. Our Service provider are well selected well with practical experience in the industry, and well trained with the Equipments & Products and the Services. But even though, all activities carry inherent risks, and there’s NO GURANTEE for any of the services or products will benefit your as expected. You acknowledge and agree that:

    • YOU will assume the entire risk arising out of your access to the Facility and use of the Equipments & ProductsServices, including interaction you have with employees or other clients whether in person or online. This means it is your responsibility to investigate a Services to determine whether you will do it or not. For example, Services may carry risk of allergic reactions, possibility of known/unknow side effects, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Services;

    • NO refunds will be given to these cause;

    • You VOLUNTARY give your permission to Spa Versante and all the staff to proceed with your desired service. And you also release Spa Versante and its employees, from any liability, damage or loss to you or your personal property now or in the future. 

  • COVID-19 has been declared a worldwide pandemic by WHO, it is extremely contagious and is believed to spread by person-to-person contact. Spa Versante and all the staff have put in place preventative measures aimed to reduce the spread of COVID-19. However, the risk of becoming infected with COVID-19 will be raised if you choose to take the Services before the pandemic is gone. You should acknowledge and assume the risk of becoming infected with COVID-19 during your visit to Spa Versante。

  • You should certify that you know of no serious health conditions that would increase your risk of illness or injury as a result of taking services offered by Spa Versante.

  • You should consult with your physician before taking any services when there is a health concern arises. or when your are not sure about if the Services/Equipments & Products are suitable to your health condition.

  • It is your responsibility to inform Spa Versante of any changes in your medical condition, including but not limited to pregnancy. 

  • Esthetic wellness & fitness training Services are no substitute for medical diagnosis and treatment.

  • If you feel any uncomfortable during your service, please let your service provider know ASAP.

  • Spa Versante will not be liable to:

    • keep/taking care of your or other person's' belongings;

    • pass your or other persons' belongings to other people;

    • babysit or supervise your or other persons' children/guardians;

    • any product/service that no provide by Spa Versante;

    • any issues according to your private contact with any employees or other clients.

Conditions:

  • Client and its guest shall only access and use the Facility for the duration of that Client’s booking of the Service.

  • At the conclusion of each Booking the Client shall immediately remove all of the Client’s  personal property from the Facility. Spa Versante reserves the right to remove and dispose of, at the Client’s expense, any of the Client’s personal property from the Facility in the event the Clients fails to comply with this paragraph.

  • Client must provide accurate, current, and complete information during registration and keep your account information up to date. 

  • Client may not transfer your account/credit/service to someone else without Spa Versante's approve. 

  • Client shall pay all amounts payable including the Services Fee and other applicable fees, like taxes, any payable debt/Penalty, etc. before the scheduled  Services start time. Gift Cards/Certificates must be present before the scheduled  Services start time.

  • Client shall arrive to and get ready in proper outfit, shoes/socks and with proper tools(yoga mat etc.) needed for the Services before the scheduled Services starting time.

  • Client can share the Plans/Services with friends & family, but:

    • Spa Royalty Program is not sharable;

    • 1 to 1 services are not sharable, please be advised that your friends and families are not allowed in the service area/rooms during your Service;

    • Extra fees applied if you upgrade your 1vs1 Private classes to 1vs more classes.

  • Business hours may be temporarily or permanently modified due to various reason.

  • All price, products and services are subject to change without prior notice.

  • Spa Services:​

    • We recommend you to arrived 20-30 minutes before your treatment time, so you can enjoy a shower and our steam and infrared sauna.

    • Spa Versante provide clean slippers, beauty wrap/bath wrap, bath towel, hand towel, disposable underwear and shower cap, basic shower and skin care products for your convenient. You are welcome to use whatever you need, but please do not waist.

    • Put the used towels in the recycle basket.

    • We do NOT offer Spa service with your own equipment/product.

  • Yoga & Fitness Services:​

    • NO outside shoes & NO barefoot allowed in the fitness training area, ONLY clean gyms shoes or full-toe grip socks are allowed.

    • We strongly recommend you to bring your own hygiene tools like yoga mat, towels etc. to enhance hygiene level.

Code of Conduct:

In addition to other prohibitions as set forth in the Terms , you are prohibited from access to the Facility and use the Services: 

  • to violate any international, federal, provincial or local regulations, rules, or laws;

  • for any unlawful, obscene or immoral purpose;

  • to solicit others to perform or participate in unlawful acts;

  • to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, race, sexual orientation, religion, ethnicity, national origin, body image, or disability;

  • to consume alcohol or any illicit substances in or around the Facility;

  • not follow to the Covid-19 Safety Plans;

  • to spread disease;

  • to spread rumors, false or misleading information;

  • to SOLICITING;

  • to collect or track the personal information of others;

  • to interfere with security of the Services;

  • to interfere with the business operation;

  • to take any Spa Versante properties out of the facility;

  • to bring any pets or animals into the Facility.

Refund & Exchange Policy​:​

  • All Plans/Services that purchased with any discount or with promotion are Final Sale, Absolutely No refund or exchange or transfer.
  • Plans/Services purchased at regular price are refundable or transferable for free within 7 days after purchasing AND 24 hours prior to the first booking. 
  • Products purchased at regular price are refundable or exchangeable for free within 7 days after purchasing with the original package. 
  • NO REFUND OR EXCHANGE to any started Services or opened product.
  • If there's a serious change in your life/health condition, you can send a request to transfer your remaining Plans/Services to another Plans/Services or to your friend, a $35 administration fee is applied if the request is approved.
  • How to request a refund/transfer/exchange:
    • Provide a written request to front desk (or send an email to info@spaversante.com from your registered email address) with all the detail information;
    • We  will get back to you with the result within 5 office business days;
    • If the request is approved, we will process the refund/transfer/exchange within 2 office business days after all the information is ready.
  • We don't sell a package/plan specific for any 1 service provider, if you prefer only 1 service provider, we will try our best to help you to book with him/her, while we could NOT guarantee that this service provider will ever have suitable time to fit your schedule, or never take days off, vacations, retired or terminate the work. We are NOT able to extend your expiry date OR refund any Plans/Services for these cause.

Plans Expiry Policy:

  • Card/Certificate

    • All Prepaid cards/certificates purchased at the original price do not expire.

    • Prepaid cards/certificates purchased at discounted prices or with promotion are valid for 1 year after purchase(can be extended* within 3 years). After 1 year, the card value can still be used but not any discounts applied. It will be regarded as your completely spontaneous abandonment 3 years after purchase.

    • Gift cards/certificates for goods/services are valid for 1 year after purchase(can be extended*/activated* within 3 years). ​

    • All  Card/Certificate donated by Spa Versante Used for charitable purposes is valid till the expiry date indicated on the Card/Certificate, or 1 year after it is issued.

    • All  Card/Certificate not not redeemable for cash and cannot be used for tips.

    • All  Card/Certificate (except the prepaid membership card) can not be replaced incase of lost, stolen or destroyed.

  • Single Services expiry 1 month after of purchase, Service Plans/Class Plans expiry 1 year after purchase(can be extended*/activated* within 3 years).

  • 1 vacation (minimum 1 month to maximum 12 month) is allowed for 3 months and 12 months unlimited class plans.

To extend* expiry date: renew/purchase a new Plans/Services before your old ones' expired, the old ones' expiry date will be extended up to the new Plans/Services' expiry date, conditions applies.

To activate* the expired Services: you can activate the left over Services of the expired Service Plans/Class Plans by paying extra fee, conditions applies.

No show Cancellation, Late Policy

  • Reservation needed for all services in the facility.

  • No Show Penalty:

    • Penalty1: $50 for each spa booking up to 2 hours; $100 for each spa booking over 2 hours;

    • Penalty2: 1/2 hour personal training session fee for each personal training booking;

    • Penalty3: 1 hour group class for each group class booking.

  • Cancellation by Client:

    • 24 hours’ notice required for cancellation and/or re-arrangement, or the No Show Penalty shall be applied.

  • Cancellation by Spa Versante:
    Due to any unavoidable reason, including but not limited to employee's emergency, equipment's failure, lack of product, pandemic, government mandated shutdown or closure, or any other cause beyond its reasonable care and control, we reserve the right to refuse or cancel any booking you place with us regardless of whether the booking has been confirmed and your payment of the total price made. If you have already paid the Total price and Spa Versante cancels your booking, we will attempt to, within a reasonable time, issue a credit to your account equal to the amount that was charged. 

  • Late by Client:

    • If you are late for your Spa service/personal training booking, your service length will cut and the service will still be finish at the original booking time, or your service will be cancelled, and the Penalty1/2 shall be applied.

    • If you are late for a group class, do NOT enter the class, your booking will be cancelled and Penalty3 shall be applied.

  • Late by Spa Versante or its employee

    • Service shall be still be provided as the original length;

    • If Client's time is not allowed, a make up of the service time shall be add into the future appointment.

    • If Spa Versante's time is not allowed, a make up of the service time and a 15 min of bonus service time shall be add into the future appointment.

Violation

  • If you found any violation please reject and report to info@spaversante.com.

  • ​If you violate the service terms your account will be temporally frozen(your expiry date won't be extend according) or permanently closed (your left over credit will be regarded as your completely spontaneous abandonment) due to the terms that you violated. 

  • If your violations cause damage to the reputation or operation of Spa Versante, Spa Versante reserves the right to pursue liability and loss.

Spa Versante reserves the right of final interpretation and decision.
